BRIAN P. BARGER

Brian Barger is a partner in the Toledo law firm of Brady, Coyle & Schmidt, Ltd., where he practices in the areas of natural resources, land use, and environmental law.

Mr. Barger is a graduate of The Ohio State University (B.A., 1975), the University of Toledo College of Business (M.B.A., 1978), and the University of Toledo College of Law (J.D., 1984). Mr. Barger is licensed to practice in Ohio, and before the U.S. District Court for the Northern District of Ohio, U.S. District Court for the Southern District of Ohio, U.S. District Court for the Eastern District of Michigan, and the U.S. Supreme Court. He is a member of the Ohio Aggregates and Industrial Minerals Association, the National Stone Sand & Gravel Association’s Council of Counsels, the Ohio Water Resources Advisory Group, and the Toledo, Ohio State and American bar associations.

Mr. Barger’s legal representation primarily includes advising clients on a range of regulatory, environmental, land use, and zoning matters pertaining to the surface mining industry. Additionally, Mr. Barger is the legal counsel to the Ohio Aggregates and Industrial Minerals Association, which represents Ohio’s non-coal surface mining industry.

Additionally, Mr. Barger is involved in lobbying efforts on behalf of the Ohio Aggregates and Industrial Minerals Association before the Ohio Department of Natural Resources, the Ohio EPA, and the Ohio General Assembly. He has been involved in the negotiating and drafting of numerous pieces of legislation, including:

• H.B. 400, amended county and township zoning for the aggregates industry.

• Am. Sub. S. B. 83, which involved a comprehensive update of Ohio’s surface mining law.

• Various administrative rules implementing Ohio’s surface mining law.

• Various administrative rules implementing Ohio’s mine safety law.
